1. Who are we?

Boogaard Insurances B.V. (hereafter Boogaard) is located at Sint Maarten. It is part of Fatum Holding N.V. and is part of Guardian Holdings Limited of Trinidad. Boogaard is also part of the Boogaard Group with offices on the islands of Aruba, Bonaire and Curaçao.

Framework of this privacy statement
Boogaard is responsible for the processing of personal data as shown in this privacy statement. This privacy statement applies to the legal entities of Fatum Holding N.V. as stated at the end of this statement.
Boogaard processes your personal data because you use our services and/or because you or your employer provide it to us via your/his adviser/intermediary (hereinafter: adviser) or directly to us via, for example, the website, e-mail or telephone.

3. Personal data we process

Below you will find an overview of the personal data that we process, among other things:


1. Name and address details
• First, middle and last name
• Sex
• Date of birth
• Birthplace
• Address data
• Telephone number
• E-mail address
• IP address
• Other personal data that you actively provide, for example in correspondence, personally, via your intermediary, by telephone and/or via Facebook.


2. Additional data for specific products
For example, your registration number with a car insurance policy or your health data or profession with a health insurance policy or accident insurance.


3. Financial information
Among other things: your bank account number or salary details (for example if you have financial products with us).


4. Special and/or sensitive personal data (if applicable)
• Health (as with health insurance, mortgage, life insurance).
• Identity number and other data (Cédula, passport, etc.)
• Marital status
• Criminal history
• Genetic data (As in a health statement)
• Data from persons under 16 years of age. Our website and/or service does not intend to collect data about website visitors who are younger than 16 years of age. Unless they have parental or guardian permission. However, we cannot check whether a visitor is older than 16. We therefore advise parents to be involved in the online activities of their children, in order to prevent data about children being collected without parental consent. If you are convinced that we have collected personal information about a minor without this permission, please contact us at privacy@boogaard.aw and we will delete this information.

4. How do we get your data?

We usually receive your data directly from you.
In other cases, we receive your data in several ways via:

5. For what purpose and on what basis do we process personal data

Which data we process about you depends on the contact we have with you. This could be if you, for example:

6. Legal basis for using your personal data

• Your consent
You can withdraw your consent at any time by telephone, email or in person at our office.
• Legal obligation
As a financial service provider, we are subject to the following legal obligations, among other things. If we do not comply with this, we may not enter into or terminate an agreement with you.
• Identification obligation. With every transaction we are obliged to keep a copy of your identification data.
• If we receive no or incorrect information from you about a criminal history.
• If we conclude an agreement with you on the basis of incorrectly provided information.
Legal bases on which we may use your personal data:

3. to comply with legal obligations such as, for example, the identification obligation

7. Automated decision making

In certain cases, Boogaard makes decisions based on automated processing on matters that can have (significant) consequences for people. 8. How long we keep personal data

Boogaard does not store your personal data for longer than is strictly necessary to realize the purposes for which your data is collected. The specific retention periods differ per product/service. Do you have specific questions about this? Please feel free to contact us at privacy@boogaard.aw.

9. Sharing of personal data

Internal
Boogaard exchanges data between the departments to process your request or to get a better overview of your products and services that you have with us.You only need to provide information such as your address or date of birth once.

Third parties
Boogaard does not sell your data to third parties and only provides it if this is necessary for the execution of our agreement with you or to comply with a legal obligation.


1. The government
This includes the Central Bank, the Financial Markets Authority, the police, the tax authorities or the Dutch Data Protection Authority if required by law.


2. Service providers
Including: your insurance advisor, doctor, pharmacy, hospital/clinic, reinsurer, collection agency,lawyers, survey bureaus, roadside assistance services, emergency number services, damage inspectors and other damage registration companies, IT support.

10. Cookies, or similar techniques, we use

Boogaard only uses technical and functional cookies. And analytical cookies that do not infringe on your privacy. A cookie is a small text file that is stored on your computer, tablet or smartphone when you first visit this website. The cookies we use are necessary for the technical functioning of the website and your ease of use. They ensure that the website works properly and, for example, remember your preferred settings. We can also optimize our website with this. You can opt out of cookies by setting your internet browser so that it no longer stores cookies. In addition, you can also delete all information previously stored via the settings of your browser.

11. Your rights: view, modify or delete data

You have the right to view, correct or delete your personal data. In addition, you have the right to withdraw your consent to the data processing or to object to the processing of your personal data by Boogaard and you have the right to data portability. This means that you can submit a request to us to send the personal data we have about you in a computer file to you or another organization mentioned by you. You can send a request for access, correction, deletion, data transfer of your personal data or request for withdrawal of your consent or objection to the processing of your personal data to privacy@boogaard.aw. To ensure that the request for access has been made by you, we ask you to send a copy of your proof of identity with the request. We will respond to your request as soon as possible, at the latest within four weeks.

12. How we protect personal data

Boogaard takes the protection of your data seriously and takes appropriate technical and organizational measures to prevent misuse, loss, unauthorized access, unwanted disclosure and unauthorized modification. If you have the impression that your data is not properly secured or there are indications of abuse, please contact privacy@boogaard.aw.

We take measures to use our IT systems and website safely. The physical spaces where we store data are secured. Authorized personnel are trained in the processing and management of personal data. There are also agreements with the employees mentioned about the integrity of personal data in accordance with legislation and regulations and codes of conduct.

13. Changing this privacy statement

This privacy statement may be changed by us if there are changes in legislation or in our organization. The adjusted statement can always be found on our website www.boogaard-insurances.com.

14. Definitions (to be found in Article 4 of the General Data Protection Regulation)

1. Personal data
Any information relating to an identified or identifiable natural person (‘data subject’); an identifiable naturalperson is one who can be identified, directly or indirectly, in particular by reference to an identifier such as aname, an identification number, location data, an online identifier or to one or more factors specific to thephysical, physiological, genetic, mental, economic, cultural or social identity of that natural person.


2. Processing
Any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.


3. Controller
The natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data; where the purposes and means of such processing are determined by Union or Member State law, the controller or the specific criteria for its nomination may be provided for by Union or Member State law.


4. Processor
A natural or legal person, public authority, agency or other body which processes personal data on behalf of the controller.


5. Third Party
A natural or legal person, public authority, agency or body other than the data subject, controller, processor and persons who, under the direct authority of the controller or processor, are authorized to process personal data.


6. Consent of the data subject
any freely given, specific, informed and unambiguous indication of the data subject’s wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data relating to him or her.


7. Genetic data
personal data relating to the inherited or acquired genetic characteristics of a natural person which give unique information about the physiology or the health of that natural person and which result, in particular, from an analysis of a biological sample from the natural person in question.


8. Data concerning health
Personal data related to the physical or mental health of a natural person, including the provision of health care services, which reveal information about his or her health status.
